According to The Orange County Register, a local man is to be arraigned next week for allegedly trying to break into Scope City, a telescope store in Costa Mesa. The suspect is being held at Men’s Central Jail in place of $50,000 bail. The alleged burglary is still under investigation.
The suspect was stopped by Costa Mesa police early Sunday morning after he was seen driving away from the strip mall where Scope City was located. Police were called to the store, which sells telescopes, binoculars, and microscopes, after the rear door alarm was triggered a little after 6:00 a.m. Officers pursued and stopped the suspect and asked to search the vehicle. The suspect allowed it, which resulted in the officers’ discovery of a .357-caliber handgun and burglary tools. The officers also found pictures and posters that are believed to have come from the store. Although the rear security door prevented complete entry into the shop, the suspect could have obtained the pictures and posters by reaching through the security gate.
In California, prosecution in a burglary case is not complicated. All that must be proven is that the suspect broke into the premises with the intention of stealing something or committing a felony. Whether or not something was actually stolen or a felony was committed has no bearing on the case. If intent is proven, then the suspect may be convicted of burglary. Because a burglary case favors the prosecution, it is important for any person arrested for burglary to consult with an experienced criminal defense attorney.

An 80-year-old woman was convicted of burglary and grand theft for stealing an $8,900 ring from a Mission Valley Macy’s store, according to 10News.com. The incident occurred when the woman walked into the store on January 2, 2010 and conversed with a sales rep at the jewelry counter for 45 minutes. When the sales rep turned her back, the woman allegedly stole the ring and left the store. Although security tapes confirmed that it was indeed the accused woman, a statement made in court by the accused said that it would be easy to pin the crime on her based on previous incidents and her notoriety. The 80-year-old woman has been to prison twice and has been convicted at least nine times in the United States alone. The woman will be sentenced on February 9.
Over the last several years, the woman has apparently hit cities such as Palo Alto and Costa Mesa as well as high end stores in Tokyo, France, and Monte Carlo. She was sentenced to twelve years in prison in 1999 for stealing a ring from a Neiman Marcus store in Denver.
Burglary and grand theft in California are serious crimes that can alter a person’s life forever. With the possibility of fines, probation and long prison sentences, an individual can face the loss of their freedom, time away from family and be considered a felon for the rest of their lives. Having any kind of conviction on your record can limit what kind of work you may do, where you can live and ultimately how you can live your life. This is especially worrisome for those individuals who may have been caught in the crossfire of a crime and were wrongfully arrested. However, you don’t have to walk this scary and uncertain journey alone.
