A 32-year-old Tustin woman was one of eight women recently arrested in a Pomona prostitution sting. As reported by The Orange County Register, the sting was conducted by the Pomona Police Department along Holt Avenue. The women, including the Orange County resident, were taken into custody for soliciting an undercover officer for prostitution. It is not clear if any of the women were released on bail.

According to California Penal Code Section 647 (b): “A person agrees to engage in an act of prostitution when, with specific intent to so engage, he or she manifests an acceptance of an offer or solicitation to so engage, regardless of whether the offer or solicitation was made by a person who also possessed the specific intent to engage in prostitution.” Prostitution is usually charged as a misdemeanor.

In order to obtain a conviction, the prosecution must prove that the individual engaged in an act of prostitution and that he or she did so willfully. The consequences of a prostitution or solicitation charge could be serious. It could remain on your criminal record and prevent you from obtaining employment, professional licenses, or admission into a higher education program.

If you or a loved one is facing sex crime charges, it is important that you contact an experienced lawyer who will help protect your rights.

A 35-year-old man has been sentenced to 16 years to life in the murder of a homeless man in Santa Ana. According to The Orange County Register, prosecutors alleged that the man killed a homeless man by beating him and throwing a 16-pound chunk of concrete on his chest. In March, an Orange County jury convicted him of one felony count of second-degree murder with a sentencing enhancement for personal use of a deadly weapon. Prosecutors also said the act was done without any provocation.

According to California Penal Code Section 187 (a), “Murder is the unlawful killing of a human being, or a fetus, with malice aforethought.” Under California law, murder may be prosecuted in the first degree or second degree, first degree being the more serious of the two charges. Basically, all homicides that do not meet the definition of first-degree murder will be charged as second-degree murder. For example, if the victim does not die within one year after the attack, a second-degree murder charge may be filed. Some of the common defenses to second-degree murder charges include “heat of passion,” self-defense, and insanity or lack of mental capacity.

Any type of murder charge in Orange County can have serious consequences for the defendant. If convicted, he or she could end up facing life-altering consequences. Murder charges could result in the death penalty, life in prison without the possibility of parole, or 15 years to life in prison.

If you or a loved one has been accused of first-degree or second-degree murder, please ensure that you have a skilled criminal defense lawyer on your side. The experienced Orange County homicide defense attorneys at the Law Offices of Jeremy N.

Police in Huntington Beach say they have stumbled into a large fraud ring after tracking down a woman wanted for a series of bad-check thefts. According to a news report in The Orange County Register, police say the woman was just a small piece of a large crime ring that has committed at least $1 million in fraud. Officials say the 35-year-old woman stole identities and forged checks to steal tens of thousands of dollars throughout Orange County and other parts of the Southland.

Huntington Beach police initiated an investigation last year when a woman reported that $24,000 had been stolen from her bank account. Police located the suspect through bank surveillance videos and linked the woman to similar incidents in Brea and Costa Mesa. In each case, she used identity theft to withdraw from the victim’s bank account, police said. Officials have made two other arrests and are looking for five other men who they say are part of the fraud ring. The woman has been charged with bank fraud in federal court.

Under California Penal Code Section 476, it is illegal to make, pass, or attempt to make or pass a fake, altered, or counterfeit check in an attempt to defraud a person or entity out of money or other property. These crimes may be charged as misdemeanors or felonies depending on the value of the money or property stolen, the nature of the crime, and the defendant’s prior criminal record.

If you or a loved one has been charged with a white-collar crime, a Huntington Beach fraud defense lawyer at the Law Offices of Jeremy Goldman can help fight for your rights and defend these serious charges.

A 28-year-old Costa Mesa man has entered a “not guilty” plea in a double murder case, which is set to go to trial. According to The Daily Pilot, the man has been charged with two counts of felony murder with sentencing enhancements that include murder for financial gain and felony use of a firearm. He is accused of killing his neighbor and his friend in May 2010.

Prosecutors allege that the defendant, with the intent to steal from the victim’s bank account, lured him to the Los Alamitos military base and shot and killed him there. He is also accused of dismembering the victim’s body. Prosecutors also say the man shot and killed the victim’s female friend, staging it to look like a sexual assault and murder. The man, a theater actor, was arrested at his own bachelor party in Huntington Beach, a day before his wedding.

Murder or homicide is an extremely serious charge with serious consequences. According to California Penal Code Section 187 (a): “Murder is the unlawful killing of a human being, or a fetus, with malice aforethought.” In addition to a murder charge, defendants may also face what are known as “sentencing enhancements” if the murder was premeditated or if it involved the use of a firearm. If convicted, defendants may face the death penalty or life in prison without the possibility of parole, depending on whether the homicide is ruled as first degree murder, second degree murder, or a form of manslaughter.

Many lives hang in the balance in a murder trial. If you have been accused of murder or manslaughter, please contact the experienced Costa Mesa homicide defense attorneys at the Law Offices of Jeremy Goldman to help defend against these serious charges.

A 41-year-old Mission Viejo man is facing criminal charges after police say they found him nude outside a home. According to a news report in The Orange County Register, the man now faces charges for indecent exposure, lewd conduct in a public place, and knowingly and intentionally exposing his genitalia, all of which are misdemeanors. The man has pleaded not guilty to all three charges. A woman told police that the man approached her wearing only a shirt.

According to California Penal Code Section 314, an individual who “exposes his person, or the private parts thereof, in any public place, or in a place where there are present other persons to be offended or annoyed thereby” is guilty of committing indecent exposure. To prove that a person committed indecent exposure or was involved in lewd conduct, the prosecutor must prove that the person knowingly and intentionally exposed himself, that he knew about the presence of others in the area, and that he intended to offend and/or annoy the people in the area.

Indecent exposure or lewd conduct, although they are misdemeanors, can have serious personal and professional consequences for defendants. Repeat offenders could face jail time, fines, and other penalties. Those facing these criminal charges would be well advised to contact an experienced lawyer who will fight to have the charges dismissed.

A 56-year-old Laguna Beach man, who was convicted of defrauding a Laguna Niguel couple of $5.5 million in a gold mining scheme, has been sentenced to 14 years in federal prison, The Orange County Register reports. He was found guilty of four counts of wire fraud and one count of failure to appear. The man apparently created the partnership with the apparent goal of funding gold extraction from abandoned mines.

After convincing the elderly couple to invest in his scheme, the man transferred the funds to 27 bank accounts. Prosecutors said he used the money without the couple’s knowledge or approval for personal items including paying off his cars and several other expenses. The man was on the lam for a short time, but was eventually arrested in Nevada.

White-collar crimes or fraud convictions can have a severe impact on a person’s life and his or her career and future. When a person is charged with several counts of fraud in Orange County, he or she could face a lengthy prison sentence and hefty fines. It is important that these fraud charges are fought efficiently and aggressive. In fact, it would be in the defendant’s best interest to seek the counsel of an experienced criminal defense lawyer even when he or she learns about an investigation – even before the charges are filed. Such a proactive approach will be helpful in getting the charges lessened or even dismissed.

The experienced Laguna Beach white-collar crime defense lawyers at the Law Offices of Jeremy Goldman have experience successfully fighting these charges. We have a thorough knowledge of how federal courts operate. If you are facing fraud charges in Orange County, please contact us at (800) 349-1619 for a free and comprehensive consultation.

A 21-year-old Mission Viejo man was arrested after officials say he brandished a knife at a local sports grill. According to The Orange County Register, police arrived on scene at the bar near Avery and Marguerite parkways near Saddleback College. A caller told police that the man was on the restaurant’s patio with a knife saying that he wanted to drink beer on the patio. Restaurant managers said the man brought his own beer and wanted to drink it. The man was charged with two misdemeanor counts of brandishing a weapon and has pleaded not guilty. If convicted, he faces a 30-day jail sentence.

According to California Penal Code Section (a) (1): “Every person who, except in self-defense, in the presence of any other person, draws or exhibits any deadly weapon whatsoever, other than a firearm, in a rude, angry, or threatening manner, or who in any manner, unlawfully uses a deadly weapon other than a firearm in any fight or quarrel is guilty of a misdemeanor, punishable by imprisonment in a county jail for not less than 30 days.”

Although brandishing a weapon is a misdemeanor offense, it can have serious consequences for the defendant including jail time, fines, and a criminal record. A knowledgeable lawyer can help defend against these charges, help defendants avoid jail time, and explore alternative sentencing options such as community service.

An Irvine attorney has been sentenced to 46 months in federal prison and must pay $7.5 million to lenders as restitution for a mortgage fraud scheme involving foreclosed homes in Orange County. According to a news report in The Orange County Register, the 41-year-old lawyer who was a former real estate broker was found guilty by a federal jury last year of one count of conspiracy to commit wire fraud.

Prosecutors say the lawyer and other “co-conspirators” bought 30 homes in Orange and Riverside counties. The loan applications would be falsified to mislead lenders, seeking mortgages for inflated sale prices. According to the prosecution, the fraud scheme resulted in more than $2 million in losses to the banks. The lawyer apparently obtained $25 million worth of property in this manner secured by $25 million in loans with no money down.

As seen in this case, white-collar crimes in Orange County can result in serious consequences including time in federal prison, restitution, fines, and serious professional repercussions. An allegation, let alone a conviction, can seriously taint a professional’s reputation and cast a shadow on his or her credibility.

If you or a loved one is facing fraud charges, it would be in your best interest to retain the services of a white collar crime lawyer who has experience successfully handling cases similar to yours.

A column in The Orange County Register talks about how the Orange County Probation Department keeps tabs on sex offenders using GPS tracking devices. The department tracks adults and juveniles on court-ordered probation supervision. The GPS Monitoring Center is apparently one of five in the nation and the only one in California that is run in-house by a government agency.

Technicians spend their days and nights behind the screens that show signals transmitted by ankle bracelets or other tracking devices worn by those on probation. This is their new way of tracking probation violators in Orange County. It works like a “virtual noose” that tightens when someone makes a wrong move. For example, on a recent day, one of the technicians spotted a convicted sex offender in a local park and alerted police officers. This technology is somewhat foolproof. For instance, an alert sounds when someone tampers with their bracelet or does not change the battery on the device.

Wearing a GPS tracking device can be an additional consequence if you have been convicted of a sex crime in Orange County. Any criminal charge should be taken seriously and vigorously defended. Having a GPS tracking device on your person 24/7 can seriously affect your personal relationships and career.
