Orange County Crime Rates Continue to Decrease

The U.S. Federal Bureau of Investigation (FBI) has recently released new data showing that crimes in Orange County as a whole fell during the first half of 2011, continuing a trend seen over the last several years. Orange County violent crime saw the biggest decrease, as was the case with the United States as a whole, and saw a small dip in the amount of property crime.

Among the cities with the largest drops in crime were Santa Ana, Garden Grove, and Orange, which all saw drops in violent crime ranging from 10 to 34 percent, including robbery, rape, murder, and assault. Irvine continued to have the lowest per capita rate for violent crimes of all cities in the U.S. with a population greater than 100,000, and it was recently named sixth on a list of the country’s safest cities for 2011, although the list is not affiliated with the FBI. However, Irvine had a 25 percent property crime increase in the first half of 2011.

On the other side, Anaheim was the only city in Orange County to see an increase in both property and violent crime during the first half of 2011. According to the FBI, the United States has seen a nine percent decrease in property crime since 2006 and a 13 percent decrease in violent crime since 2001.

Suspect in Stanton Stabbing Arrested after Anaheim Hit-and-Run

The Orange County Sheriff’s Department took a man suspected of stabbing his father into custody in the afternoon on Black Friday, November 25, according to The OC Register. The stabbing occurred that morning at a Stanton home on Lampson Avenue. The victim, who was in his late 50s, suffered a stab wound and was transported to a hospital after being allegedly stabbed by his 22-year-old son, who then left the scene in a white Dodge pickup truck. Motive has not yet been determined.

Orange County investigators, with help from Fullerton police, searched a vehicle leaving a Fullerton relative’s home in the early afternoon, but no one was taken into custody at that time. Not long after, police reported an Anaheim hit-and-run crash involving a pickup truck matching the description of the one driven by the son. The hit-and-run pickup collided with a parked car near Del Monte and Westchester. The pickup’s driver and stabbing suspect was found walking along West Cabot Drive. He was taken into custody by Anaheim police, who later turned him over to the Orange County Sheriff’s Department.

FBI “Crime in the United States” Report Shows Decline in 2010 Crime Rates

According to the Los Angeles Times, the Federal Bureau of Investigation (FBI) has released the 2010 crime rate report. Based on the FBI crime statistics, an estimated 10.3 million crimes were reported in 2010. Although these numbers seem high, both violent crime and property crime rates have in fact declined from previous years. Property crime dropped as well, though not as drastically, with a 2.7 percent decrease from 2009, making 2010 its eighth consecutive year of decline. Other statistics conclude that aggravated assault was the most common violent crime in 2010 and that larceny-theft was the most common property crime. A total of 13.1 million arrests were made (excluding traffic violations) for crimes in 2010.

In Orange County, there were 187 violent crimes in 2010. As with the national statistics, aggravated assault was the most common violent crime. In addition, Orange County had a total of 1,275 property crimes, the most common being larceny-theft.

Notorious BIG Case Dismissed for Further Investigation

Rapper Notorious BIG’s wrongful death case against the city of Los Angeles was dismissed Wednesday, April 21, 2010 after lawyers from both sides agreed that the case could be re-opened, or re-filed, later.

The case had been filed in 2003, alleging wrongful death in a fatal shooting that occurred in March 1997 minutes after the 24-year-old rap star left a Los Angeles party, according to AVVO. Judges deemed the case a mistrial in that LA police had withheld incriminating documents, including statements from a prison informant that linked two police officers to the killing. As a result, the city of LA was ordered to pay over one million dollars to the family of the deceased.

The dismissal of the trial is said to allow investigators to make the necessary arrests over the death without being held liable. The criminal investigation is still ongoing, preventing the plaintiffs from accessing some records circling the case. The claim would most likely be re-filed in two to three years, depending on the investigation.

Cases involving violent offenses are some of the most complex. A person convicted of an Orange County violent crime may face serious and life-changing penalties, some of which may include steep fines, years in prison, societal scorn, loss of employment, and much more. Fifteen Years after the Fact, USC Student’s Shooting Could Be Reopened as a Homicide Case

The L.A. Times reported recently that the case of a USC student who was shot in 1994 may be reopened – as a homicide investigation.

Fifteen years ago, the student, who was 27 at the time, was injured by a bullet fired from a stolen handgun. The bullet severed her spinal cord, leaving her permanently paralyzed. At the time of the shooting, she was sitting in a car with her friend, who suffered a gunshot wound to the leg.

In January 2010, the student passed away. At the autopsy, her death was listed as a “homicide.” The coroner believes her death may have been caused by complications related to her paralysis and/or the original gunshot wound.

The shooter, who was 14-years-old at the time of the incident, has already served his sentence for attempted murder in this case in a juvenile detention facility. The Los Angeles Sheriff’s Department is waiting for a final report from the coroner on whether the student’s death was related to the shooting. Meanwhile, the Sheriff’s Department is reviewing the case, trying to decide whether a homicide charge is allowed in this case and, if so, whether that charge should be filed.

When facing the complicated maze of homicide or violent crime laws, nothing is more important than having an experienced Orange County violent crime defense attorney who will fight for you. Serial Killer Sentenced to Death

The L.A. Times recently reported that a serial killer had been convicted for five murders committed in the 1970s. The convicted man, a former photographer and onetime contestant on “The Dating Game,” chose to proceed without criminal defense counsel. He represented himself in a trial that began in January 2010. The jury convicted him of the murder of five different women. At his sentencing, the jury sentenced him to death for the killings despite his request that they sentence him to life in prison without parole.

The man had been convicted of one of the murders, the death of a twelve-year-old girl last seen riding her bike to ballet class in June 1979, on two previous occasions. Misconduct on the part of the prosecution and the judge in each of the previous cases lead to those sentences being overturned. He had also been charged with the murder of a second victim in 1980, but the district attorney was forced to drop the charges after it learned a key witness had committed perjury.

Criminal trials always carry a risk of mistakes, confused or lying witnesses, or misconduct. An experienced criminal defense attorney is a necessity in a criminal trial. Such an attorney will fight vigorously to protect the rights of the defendant against pitfalls like coerced confessions, improper evidence, lying or biased witnesses, or misconduct by the prosecution. Woman Murdered in Alleged Domestic Violence Dispute

A Thai woman from Petaluma was allegedly murdered by her husband. The 36-year-old woman was found with a gunshot wound under her right eye with no other injuries present. The cause of death is pending a toxicology report. The man had called Petaluma police shortly after the murder and said he had shot his wife. Police arrested him without incident; and he is being held in Sonoma County jail under no bail.

The couple apparently had a history of domestic violence disputes. In one alleged argument, the husband had come home drunk, pushed his wife down the stairs, broke a sink and then proceeded with threats of suicide if she left him. The woman’s friends and coworkers encouraged her to notify the police about her husband’s irrational behavior, but she was hesitant because of her shyness towards speaking English.

The husband is being charged with first-degree murder with weapons enhancements and possession of an illegal assault weapon, an SKS rifle with detachable magazine. He pleaded not-guilty last Wednesday in a Sonoma County Superior Court and awaits trial scheduled for February 4. If convicted, the man faces 50 years to life in prison.

Today, nearly half of all late night calls to police are because of domestic violence disputes. In 1980, a study done by Straus & Steinmetz reported that nearly one in 25 families in the U.S. experience severe domestic violence that leads to serious injuries or death.

Being accused of domestic abuse can also be devastating, especially when stories are twisted with important facts forgotten. If you’ve been accused of domestic abuse in southern California, you may want to speak with an experienced Garden Grove domestic violence attorney at the Law Offices of Jeremy N. Goldman. We can help you clear your name and build a strong defense. Call today at (714) 953-5144 for a comprehensive consultation.

Man Convicted of Murder Released from Prison after 26 Years

A 44-year-old man who has spent almost 26 years in prison will soon be set free. He has pleaded guilty to voluntary manslaughter for the 1984 murder of his older male roommate. The man was convicted and sentenced to 17-years-to-life for second-degree murder. An Orange County Superior Court judge granted the convict a new trial under the pretext that the man should be allowed to submit evidence of “intimate partner battering” as a partial defense to the murder charge.

Prosecutors decided against a retrial and, instead, offered the man a plea bargain to voluntary manslaughter that allots for 13 years in prison. The man accepted the conditions and will soon be released since he has already served his time. After pleading guilty, the convict apologized for the crime.

During the original trial in 1984, the man, 18-years-old at the time, claimed his actions were a result of self-defense even though the victim was stabbed more than 30 times with a steak knife and wood chisel. He alleged that the victim had threatened him with a knife and wanted to sodomize him.

New laws indicate that defense attorneys are allowed to contest murder charges on the grounds of a psychological toll inflicted by the victim on his killer. If you have been accused of murder or manslaughter, do not speak to anyone about the crime before consulting a skilled Orange County homicide defense lawyer. The attorneys at the Law Offices of Jeremy N. Goldman have experience with jury trials, having settled several high profile homicide cases. Call (949) 622-5417 for a confidential consultation.

79-Year-Old Man Charged with Assault and Battery of a Police Officer

A 79-year-old Vietnamese American man has announced that he is a victim of a “horrible injustice.” In October, he had been cited for driving 52 mph in a 35 mph zone when he became agitated and punched and kicked the police officer twice in the chest, shoulder and groin.

The officer took the 79-year-old man to the ground and handcuffed him, leaving minor abrasions on his wrists and face. Shortly after, the man was taken to a nearby hospital for the injuries. The report also indicated that the usual procedure for assaulting a police officer is to book the assailant in Orange County jail; however, police released the man from the hospital with just a citation because of his age.

The man maintains that he did not attempt to assault the officer and feels that his civil rights have been obstructed, requesting police to conduct an internal investigation and file a federal civil rights complaint. The defense claims that the incident occurred largely because of cultural differences.

According to the defendant’s family, the man was attempting to show respect to the officers by standing up. He refused to sign the citation because in Vietnam, signing papers indicates a guilty plea. The Orange County District Attorney has charged the elderly man with one count of each misdemeanor battery and assault.

A conviction of assault or battery can have negative and lasting effects on a person’s record. It could prevent employment and affect your relationships with others.
