Malice aforethought is a broader term. It constitutes a state of mind that's potentially dangerous. That state of mind could involve the intent to kill or seriously harm another human being. It could involve reckless negligence or indifference to human life. Finally, it can involve intent to commit a felony. To convict someone of felony murder in California, however, the prosecution must show that the offender was engaged in a particularly dangerous kind of felony, such as arson, rape, or burglary.

The actus reus involves the actual physical homicide. The mens rea involves the state of mind of the person who committed the killing. As discussed above, in order for a homicide in California to qualify as a murder, the offender's action must have been intended, pre-meditated, or brought on by wanton negligence.
Are All Homicides Considered Criminal Offenses?
No. In some cases, homicides can result from unfortunate or accidental circumstances. For instance, if a driver accidentally kills a pedestrian who enters into the street for no reason, the driver cannot be charged with a crime unless it can be shown that his/her negligence was in some way responsible for the death.
