    Mens rea is the component of theft related to intent. It is the act (whether completed or not) of intending to steal from an authorized owner or holder.

    What is an example of actus reus without mens rea?

    A young woman dines out at a restaurant and gets so involved in her conversation that she carries her fork home with her in her hand. The woman may not have intended to take the fork (mens rea) but she did physically deprive the rightful owner (the restaurant) of the object in question, so she did commit actus reus.

    What's an example of mens rea without actus reus?

    A burglar cuts a home security system's alarm and breaks into a house through a window. But a neighbor sees the break-in and calls the police before the burglar can grab any money or valuables. The burglar committed mens rea (intending to steal) but did not commit actus reus (i.e. he did not succeed in the robbery).

    In general, the law considers mens rea to be an ethically more serious crime; however, defendants convicted of only actus reus theft can nevertheless be sentenced to serious punishments, such as fines and jail time, depending on the nature of the theft offense and extent of the damage it caused.
